Acceptance of terms
By accessing or using the Custodios Index website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site.
These Terms constitute a legally binding agreement between you and Custodios Group LLC ("Custodios Index," "we," "us").
These Terms incorporate by reference our Legal Disclaimers (/legal) and Privacy Policy (/privacy).
Eligibility
To use the Custodios Index website, you must:
— Be at least 18 years of age
— Have legal capacity to enter binding agreements
— Use the Site in compliance with applicable laws in your jurisdiction
— Not be subject to sanctions or restrictions that would prohibit your use
If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Permitted use
Custodios Index grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for:
— Personal review and study of methodology
— Academic research with proper attribution
— Journalistic reference with attribution
— Individual investment decisions for your own portfolio
— Internal use by family offices and institutions for their own assets
— Newsletter subscription to receive updates
For commercial use including ETF replication, structured products, external benchmarking, or revenue-generating applications, a separate licensing agreement is required. Contact contact@custodiosindex.com.
Prohibited use
You agree NOT to:
— Use automated systems to scrape, harvest, or extract data systematically
— Reverse engineer proprietary calculation methods
— Republish or redistribute Custodios Index content as your own
— Use Custodios Index in violation of applicable laws or regulations
— Attempt to gain unauthorized access to non-public areas
— Interfere with site operation or security
— Misrepresent affiliation with Custodios Index
— Use Custodios Index branding without authorization for commercial purposes
— Engage in any commercial replication without a license agreement
— Use the site to harass, defame, or harm others
— Upload viruses, malware, or harmful code
— Violate intellectual property rights of Custodios Index or third parties
Custodios Index may suspend or terminate access for violations without notice.
Intellectual property
All content on the Custodios Index Site — including methodologies, index names, branding, text, graphics, data analyses, research database, code, and design — is owned by Custodios Group LLC or licensed to us, and is protected by U.S. and international intellectual property laws.
PERMITTED ATTRIBUTION:
When referencing Custodios Index in research, journalism, or academic work, include:
— Provider name: "Custodios Index"
— Index name: e.g., "CI-WORLD10"
— Source: "custodiosindex.com"
PROHIBITED USE OF MARKS:
Use of "Custodios Index," index names, or related branding for commercial products without license is strictly prohibited.
User-submitted content
If you submit content (newsletter signup, licensing inquiry, communication), you grant Custodios Index a non-exclusive, royalty-free license to use, store, and process that content for the purposes of providing the relevant service and responding to communications.
You represent that any content you submit is your own or that you have authority to share it, and does not violate third-party rights.
Disclaimers
The Site and all content are provided "AS IS" without warranty of any kind. Custodios Index disclaims all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.
Custodios Index does not warrant that:
— The Site will be uninterrupted, error-free, or secure
— Data is accurate, complete, or current
— Errors will be corrected
— The Site is free of viruses or harmful components

Limitation of liability
To the maximum extent permitted by law, Custodios Group LLC and its affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Site, including but not limited to lost profits, lost data, business interruption, or investment losses.
Total aggregate liability shall not exceed $100 USD or the amount you have paid to Custodios Index in the preceding 12 months, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Custodios Group LLC, its officers, directors, employees, and contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
— Your use of the Site
— Your violation of these Terms
— Your violation of any third-party rights
— Investment decisions you make based on Custodios Index content
— Any commercial use of Custodios Index intellectual property without authorization
Termination
Custodios Index may suspend or terminate your access to the Site at any time, for any reason, without notice.
Upon termination, your right to use the Site ceases immediately. Provisions that by their nature should survive termination (including IP rights, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
Dispute resolution
GOVERNING LAW: These Terms are governed by the laws of the State of Delaware, USA.
NEGOTIATION FIRST: Before formal dispute resolution, parties agree to attempt good-faith negotiation for at least 30 days.
BINDING ARBITRATION: Unresolved disputes shall be resolved through binding arbitration in Wilmington, Delaware under American Arbitration Association rules.
CLASS ACTION WAIVER: Disputes must be brought individually. Class actions, collective proceedings, and representative actions are waived.
EXCEPTION: Either party may seek injunctive relief in Delaware courts for intellectual property or confidentiality matters.
General provisions
ENTIRE AGREEMENT: These Terms, together with the Legal Disclaimers and Privacy Policy, constitute the entire agreement regarding your use of the Site.
SEVERABILITY: If any provision is found unenforceable, the remaining provisions remain in effect.
NO WAIVER: Failure to enforce any provision does not waive future enforcement.
ASSIGNMENT: You may not assign these Terms. Custodios Index may assign these Terms in connection with corporate transactions.
MODIFICATIONS: Custodios Index may modify these Terms at any time. Continued use after modifications constitutes acceptance.
